Requirements to qualify for naturalization:

  • Mandatory number of years as a lawful permanent resident (normally five years with exceptions)
  • Physically in the US for majority of the mandatory number of years (as lawful permanent residents)
  • A good moral character
  • 18 years or older
  • Must pass the English test (with exceptions)
  • Must pass the civics test (with exceptions)

Acquired and Derivative Citizenship / Child Citizenship Act

Under Child Citizenship Act, a child automatically becomes a U.S. citizen when the following conditions have been met:

  • At least one U.S. citizen parent
  • Child is under 18 years old
  • Child resides in U.S. in the legal & physical custody of a U.S. citizen parent
  • An un-adopted stepchild doesn’t qualify for citizenship under this
  • Other requirements exist for children residing outside the U.S. and/or adopted children
