Under Child Citizenship Act, a child automatically becomes a U.S. citizen when the following conditions have been met:
Citizenship/Naturalization
Requirements to qualify for naturalization:
- Mandatory number of years as a lawful permanent resident (normally five years with exceptions)
- Physically in the US for majority of the mandatory number of years (as lawful permanent residents)
- A good moral character
- 18 years or older
- Must pass the English test (with exceptions)
- Must pass the civics test (with exceptions)
Acquired and Derivative Citizenship / Child Citizenship Act
- At least one U.S. citizen parent
- Child is under 18 years old
- Child resides in U.S. in the legal & physical custody of a U.S. citizen parent
- An un-adopted stepchild doesn’t qualify for citizenship under this
- Other requirements exist for children residing outside the U.S. and/or adopted children
